What is an Executor Bond?
An Executor or Executrix is a fiduciary named in a will to manage or distribute the assets of an estate and pay all just claims and debts. Court fidiciaries are generally required by law to provide a surety bond for the faithful performance of their duties and compliance with the orders of the court having jurisdiction.
An Executor Bond (sometimes called an Executrix Bond when the fiduciary is female) guarantees faithful performance of duties whereby the administrator takes possession of the decedent's property, inventories and arranges for appraisal, collects debts due to the estate, pays all debts and claims against the estate and distributes all remaining estate assets according to the terms of the will.
