The direct marketer sent the "excellent credit" applications to the group with a poor credit history and the response to the mailing was immense. The bank sued the direct marketer for negligence over the mailing error. The direct marketer paid over $1 million to settle the case. Commercial General Liability Insurance does not provide coverage for errors, contract performance disputes or any other Professional Liability issues. Companies who have General Liability without Professional Liability / Errors and Omissions Insurance coverage are taking a serious risk.
