Contractors Professional Liability / Errors & Omissions Insurance

What is the Purpose of Owners & Contractors Protective Liability Coverage?
Owners & Contractors Protective Liability Coverage (or OCP, also known as Contractors Professional Liability Insurance or Contractors Errors & Omissions Insurance) protects your company from claims if your client holds you responsible for errors, or the failure of your work to perform as promised in your contract.
Contractor's E&O is a form of liability insurance designed to protect either a property / business owner or a general contractor for the potential liability exposure that results from the negligent act of a subcontractor or an independent contractor hired to perform work on the insured's behalf. This type of policy is designed to provide protection above and beyond the coverage generally offered by comprehensive general liability insurance.
Coverage includes legal defense costs and will pay for any resulting judgments against you, including court costs, up to the coverage limits of your policy.

Who Is Protected by an OCP Policy?
The independent or subcontractor is the actual purchaser of the policy but the protection is for the insured who is either the property / business owner or a general contractor for whom the work is being done. Coverage is limited to a specific location and project.
How is Contractors Errors & Omissions Coverage Purchased?
A separate policy allows the project owner / general contractor to better control the policy and make sure the limits are not diluted by other claims against the subcontractor. This coverage could also be provided by attaching an additional insured endorsement to the contractor's policy, but the protection is not as complete.
What Are the Differences Between CGL Coverage and Contractor's Errors & Omissions Coverage?
Generally, the contractors errors and omission policy is written on a claims-made basis. Although it is likely that the policy will require that the negligent act, error or omission take place during the policy period, some policies make an exception for a negligent act, error or omission that takes place prior to the policy's inception. The usual conditions precedent are that no other insurance is available and the insured does not know or could not have reasonably foreseen that such negligent act, error or omission might be the basis of a claim or suit.
